Kitten/Cat sold as pet Alter Agreement: Kitten is spay/neuter prior to being sent to new home The seller represents that the kitten/cat sold hereunder is free from worms, fleas, ear mites, and other internal or external parasites to the best of the seller’s knowledge.
1. All sales are final! No returns, refund, or exchanges except what is outline by terms of this agreement. Deposits are non-refundable.
2. Seller guarantees this kitten to be in good health at the time of sale. The buyer has a health guarantee extending for 48 hours from the day of purchases and delivery. Seller advises the buyer to have kitten examined by a license veterinarian during this period. If the veterinarian finds a serious life threatening congenital condition, it will be exchanged for another kitten of equal value or full refund will be made, upon written report from the veterinarian the said kitten is “unfit for sale”. The kitten must be returned during the 48 period. No exchanges will be made after this time period has expired. Under no circumstances can the kitten be returned if it has been exposed to other cats/kittens. The kitten cannot be destroyed prior to notification by purchaser to seller.•
3. The kitten/cat is guaranteed against congenital defects until one year of age. Should the cat die within the time as direct result of a congenital defect, the cat will be replaced ONLY if a licensed veterinarian performs an appropriate necropsy and veterinarian certificate is provided as proof of cause of death. Cost of the report and examination is the responsibility of the buyer. It is strongly recommended to have Nationwide Pet insurance for said cat. A 3 year HCM health guarantee is given ONLY with proof of yearly HCM scanning done by the age of 1.
4. The seller assumes no responsibility of this kitten after leaving the premises of the seller for medical expenses due to injury, landlord’s or spouse disapproval, allergy to animals, disagreement of family, conflict of personality or for any other reason unless outlines in this agreement. Therefore, it is agreed that no warranty or representation has been made with respect to sold kitten except as set forth in writing in this agreement.
5. If this kitten is found to be neglected or mistreated, purchaser will surrender said kitten to seller, unconditionally.
6. Under no circumstances will this kitten/cat be sold, leased, or given away to any pet shop or research facility.
7. Should the purchaser at any time in the future decide to sell this cat/kitten, the seller will be given first opportunity to take the cat/kitten back free or charge, except shipping if applicable.
8. Registration papers will be provided and mailed upon transfer of ownership through CFA/TICA after cat/kitten been in home for more than 48 hours.
9. This cat/kitten will not be exported outside the USA without proper paperwork and clearance of the USFW. Seller holds no responsibility of any kind if this is not done directly.

10.The stress of moving to another home may cause soft stools. Give your kitten time to adjust to his/her new environment.
11.Introduce your cat/kitten slowly to other pets and give him/her time to adjust, at least 2-3 weeks. The kitten should be in a quarantine area such as, bathroom or small room. The room should be calm and stress free. Your new kitten is litter box trained when he or she leaves the seller. Please show him/her where the litter box and food are several times a day. Buyer shall provide adequate indoor sanitation facilities and shall never allow the cat to roam freely outdoors.
12.Buyer agree to keep new kitten from contact with other cats/kittens that haven’t been tested for Feline leukemia, FIP, illness or fungus. Buyer is aware that the stress of moving the kitten can cause a break out of cold-like symptoms and/or coccidia. This is not a congenital or genetic condition. Every animal has coccidia in his/her intestines and the outbreak is caused by too much stress, therefore any medical and or veterinary treatment is the responsibility of the buyer.
13.FIP (FELINE INFECTIOUS PERITONITIS), cat/kitten will be fully vaccinated against Corona virus, it is buyer’s responsibility to maintain vaccine updates. If FIP Is to occur in purchased cat/kitten seller will refund buyer with proof buyer maintained annual vet visits and necropsy report.
14.This contract agreement is binding to buyer and seller and is non-transferable. By receipt of this contract, Buyer agrees with the terms and conditions of this contract and revoke all rights to the California Pet Lemon Law. Any legal action will be paid by the buyer and will take place in Riverside County, California.
15.NO cash refunds. No exceptions. Deposits are non-refundable! Buyer will not dispute any fees and/or funds paid by using PayPal or other credit card transactions at any time. This signed contract at the time of pick-up of cat/kitten or shipping documents are proof of the kitten/cat being received by the buyer.
16.The non-prevailing party in any dispute under this agreement shall pay all costs and expenses, including expert witness fees and attorney’s fees, incurred by all the prevailing party in resolving such dispute.
17.The kitten/cat will not be DE-CLAWED. Having kitten/cat DE-CLAWED will void all guarantees on any kitten/cat.
18.It is understood that with Sphynx Breed hairlessness will vary from kitten to kitten due to hormones, climate, and genetics. It is important for the purchaser to understand it is impossible to guarantee complete hairlessness for the life of the kitten/cat. It is possible for kitten/cat to develop some hair especially after being spayed/neutered or as it grows older. This hair is specific to the tail, feet, and ears.
SPECIAL CONDITIONS
1. The said kitten will not be given live virus vaccines; this will void the health guarantee. The said kitten will only be given modified live (MLV) or killed virus vaccines.
2. The said kitten will not be given FIP vaccines. This will void the health guarantee.
3. The said kitten will be guarantee tested negative for Feline Leukemia when it leaves seller’s house. Therefore, the seller does not guarantee the kitten against Feline Leukemia once it leaves seller’s home.
4. If Seller’s reputation is negatively affected by any miscommunication, argument, or information shared and/or posted on any social media, person to person, website, or complaint board, said Seller will have the right to disclose all information on said Buyer. Which will include but not limited to buyer’s contact/personal information. In the event Seller believes the reputation, community standing, integrity or good name of Nocturnal Sphynx have been damaged, intentionally or otherwise as the result of Buyer’s actions or comments, Seller has the right to prosecute to the fullest extent of the slander/ liable laws.
THIS AGREEMENT SETS FORTH AND CONSTITUTES THE ENTIRE AGREEMENT AND UNDERSTAND OF THE PARTIES WITH RESPECT TO THE SUBJECT MATTER HEREOF. THIS AGREEMENT SUPERSEDES AND ALL PRIOR AGREEMENT, NEGOTIATIONS, CORRESPONDENCE, UNDERTAKINGS, PROMISES, COVENANTS, ARRANGEMENTS, COMMUNICATIONS, REPRESENATIONS, WHETHER ORAL OR WRITTEN, OF ANY PARTY TO THIS AGREEMENT.
